AMMA Bars Condition of Probation Preventing Medical Use of Marijuana

2/5/16  Arizona Medical Marijuana Act (AMMA) bars a Condition of Probation preventing a Probationer from the Medical Use of Marijuana

The Arizona Court of Appeals has ruled that the Arizona Medical Marijuana Act (AMMA) allowed a defendant who was on felony probation, and who had an AMMA Card, to use marijuana even though the written conditions of probation which the defendant had agreed to prohibited the use of illegal drugs.  The court said AMMA bars the State from imposing any penalty for the use of Medical Marijuana.  The Arizona Supreme Court has adopted the Court of Appeals decision and by doing so has made this Arizona state law.
