
After legal battles lasting six years, and after much of the original legislation has been struck down in federal courts, an agreement has been reached between Arizona and immigrant rights groups in regard to the remnants of Arizona Senate Bill (SB) 1070.
Under the terms of the agreement, Arizona Attorney General Mark Brnovich will release guidance to law enforcement on how the remaining provisions of SB 1070’s immigration enforcement law may be used and the immigration rights coalition will agree to abandon legal challenges to same, subject to federal judicial approval.
AG Brnovich will issue an informal opinion making clear to local law enforcement firstly that illegal status is a civil and not a criminal violation, that race and ethnicity cannot be used to justify suspicion of illegal status, that illegal status cannot be the sole basis for an arrest, and that prolonging detention of a person to check immigration status is not permitted.
The opinion goes on to state that under the remaining key provision, Section 2b, probable cause of federal immigration crimes would justify arrest. Coalition attorneys have stated the decision to drop opposition to SB 1070’s remaining provisions will not prevent them from filing new challenges if local police do not adhere to the AG’s issued policies.
