5/13/16 It is alleged by the ACLU in letters forwarded earlier this week to Tucson Police Chief Magnus and Department of Homeland Security Secretary Johnson, that the Tucson Police Department has baselessly and illegally detained people on immigration checks performed under Arizona Senate Bill 1070, far in excess of what is required to complete the original traffic investigations.
ACLU staff state this occurred in 85 out of 110 traffic stops taking place between June 2014 and December 2015, which adds up to an incredible 77%. In more than a dozen cases, false positives indicated unlawful presence which was later found to be unjustified.
Tucson Police Department policy, adopted in January of 2015, specifically prohibits officers from postponing a person’s release from custody solely for the purpose of investigating immigration status, and further goes on to expressly state a non-response from ICE or Border Patrol provides “no basis” for delay.
A meeting is scheduled next week between Tucson Police brass and ACLU staff to discuss the allegations raised.
