4/15/16 Arizona law now mandates a one-year revocation of a person’s Arizona driver’s license or privilege to drive if they are found guilty of a first offense Driving Under the Influence (DUI) of Drugs or Driving With a Drug in Their Body Without a Valid Prescription. By contrast, a person who is convicted of DUI Alcohol only receives a 90-day suspension, unless the person refused to submit to the requested chemical tests. This law treats prescription drug users unfairly because if they are using prescription drugs as prescribed but are impaired to the slightest degree, there license is revoked for one year, whereas a driver who has first offense extreme DUI alcohol level and causes a non-injury accident is only subject to a 90-day suspension.
Arizona Session Laws 2016, Chap. 57 changes this and eliminates the mandatory license revocations for DUI drugs. Now those guilty of DUI Drugs will be subject to the same suspension as DUI Alcohol drivers. Unfortunately the law does not take effect until December 31, 2016 and provides no relief for those already found guilty of, or awaiting trial for, DUI Drugs.
