Records ordered unsealed in Freeway Shooting case

5/11/16  Late last month the Maricopa County Superior Court case against the man accused of being the Phoenix Freeway shooter, Leslie Merritt, Jr., was dismissed without prejudice (see our blog post here).


Yesterday a hearing was held on the defense’s motion to unseal pleadings, which would lift the existing gag order issued by Judge Warren Granville.  The motion was granted, and the judge ordered the public release of the documents within the next 2 weeks.  The release will include the hotly anticipated State experts’ ballistics report, which defense attorneys have stated is the basis for the charges being dismissed.


State experts originally linked a gun belonging to Merritt to the bullets fired in 4 of the 11 freeway shooting incidents which took place in the fall of last year, but there is now serious doubt about the strength of that link.


The defense has also filed a motion to release property, including Mr. Merritt’s car and gun, for which a hearing is scheduled June 17th.
