As a Maricopa County Marijuana DUI Lawyer I know an arrest for a DUI or other criminal charge means you are no longer in control of your life.
You may have to:
- Stop driving
- Attend many court and counseling sessions, thus jeopardizing your job
- Serve jail time
- Lose your job
- Lose custody of your minor children.
Never assume that because the police say you are impaired by THC a jury you will find you guilty!
Marijuana THC DUIs are very Different from Alcohol DUIs
A driver is guilty of an Alcohol DUI is their alcohol level is more than .08% within 2 hours of driving, even if they are not impaired. Marijuana (THC) DUIs are different because by law there are no automatic or per se limits of active DUI in the blood which makes the driver guilty if if they are not impaired. In 2020 the voters approved Proposition 207 which says a driver is guilty only if they are impaired. That Proposition prevents the Legislature from setting per se limits for active THC in the blood unless and until the scientific evidence clearly shows all people are impaired at a certain level. A highly respected Yale University respected scientific article recently reviewed many scientific studies and said science cannot establish THC level at which all people are impaired. If highly respected scientists cannot say people are impaired at a given level nor can the police.
