How To Avoid Jail for DUI in Arizona

Avoid Jail For DUI by Dismissal for a Legal Reason

If there is a legal error in what the police or a prosecutor has done it may be possible to have a case dismissed. An example is if the officer stopped the defendant’s vehicle without a legal reason to do so.

Avoid Jail for DUI With a Plea Agreement for a Different Charge

The prosecutor may agree to a plea offer to a different charge which jail is not required. Reckless Driving and Misdemeanor Endangerment charges have no mandatory jail time. A plea agreement for a different charge is only possible if the prosecutor agrees to it. The Phoenix City Prosecutor for example never agrees to change a DUI to Reckless Driving. The Maricopa, Navajo and Pinal County Attorneys may agree to Reckless Driving. An agreement has to be an “agreement” and so if the prosecutor still insists on jail and so you may have to do some jail.

 Winning a Jury Trial

If the verdicts are not guilty then is no sentence and no jail.

Avoid Jail for DUI With Credit for Time Served

Some prosecutors will agree to give a defendant who pleads guilty credit for time served in jail. As of 2022 this is become rarer because by law a day in jail must be at least 8 hours.
So that’s the answer to today’s question, is there any way to avoid jail for DUI time in Arizona?
