A new study written by Harvard law professor Andrew Manuel Crespo shows criminal defendants are infrequently represented by expert counsel at argument before the US Supreme Court.
The study, which used data from a 10-year period ending June 2015, determined nearly 2/3’s of arguments presented on behalf of criminal defendants were undertaken by attorneys who had never appeared before the US Supreme Court. By comparison approximately 50% of civil cases were handled by lawyers deemed expert, generally perceived as being one who has appeared 5 or more times.
While prosecutors are often similarly inexperienced, they have the benefit of assistance from experienced lawyers with the US Solicitor General’s office, which lawyers participated or handled argument in more than 72% of criminal cases.
