6/23/16 The United States Supreme Court issued a ruling today upholding the constitutionality of the University of Texas’ using affirmative action as a factor in its admissions decisions. The decision affirms the ideals behind affirmative action, recognizing the value in achieving diversity in higher education.
Affirmative action is a policy, in use around the world, which seeks to relieve discrimination by means of a slight favoring of those suffering from discrimination, particularly in the areas of jobs or education.
The University of Texas admissions policy first reserves approximately 75% of its admissions slots for graduating high school seniors at the top 10% of their class; for the remaining 25%, the issue was whether the University’s policy of considering race as one among many factors in making decisions on admission is lawful under the Equal Protection Clause.
In its affirmance of the University’s admissions policy the court noted the plan had been developed and refined over time, and urged it continue to review and reevaluate in an effort to ensure diversity comes not at the expense of equal protection.
At this time Arizona is one of eight states to have banned the use of race as a factor in college admissions.
